Whistleblower law, or qui tam law, is a citizen's chance to
correct a wrong in our society and reap rewards for it. Qui tam
is the name of the whistleblower provisions of the Federal False
Claims Act. A 1986 amendment to the Federal False Claims Act
guarantees a minimum of 15 percent of the recovery and a maximum
of 30 percent as an award to the qui tam relator
(whistleblower).
Whistleblower laws allow you to file a legal action, or lawsuit,
in the name of the government in order to present your evidence
that a company is defrauding the government. The whistleblower
receives a percentage of money recovered by the government as a
reward. If the government joins your lawsuit, you may receive
between 15 and 30 percent of the monies recovered. Some state
laws also provide similar enticements.
There
are some restrictions on recovery awards:
-
You
must file your lawsuit before anyone else using the same
information.
-
Federal whistleblower law does not cover income tax fraud.
-
Your
whistleblower claim must not be based on public information.
A
whistleblower complaint, or lawsuit, is generally assigned to a
government attorney. This attorney must rely on government
investigators, and the U.S. Department of Justice may frequently
ask the FBI to investigate your claim of fraud or mismanagement.
You
have the right to an attorney who will protect your interests in
a whistleblower lawsuit. The Justice Department's handling of
the case before settlement may not be in your best interests.
You have the right to go to the judge handling the case if you
believe there is conflict of interests or that the case is not
being prosecuted aggressively enough.
Whistleblowers, who prove harassment due to whistle blowing, are
entitled by law to compensation for the harm done them. The law
states that this shall include "reinstatement with the same
seniority status... two times the amount of back pay, interest
on any back pay, and compensation for any special damages."
Properly handled by lawyers who are experienced in whistleblower
litigation and Disclosure Statements, and who know how to use
proper investigation in order to prove fraud, a whistleblower
lawsuit can be quite rewarding. The percentage of the award is
determined by the value of the evidence. It is important to seek
counsel from an attorney who knows proper legal investigation
for evidence and quality legal document preparation.
