GENERAL WHISTLEBLOWER FAQ

  1. What does qui tam mean?  Qui tam is simply Latin for "Whistleblower".
     
  2. My company is cheating the government on a contract. I can't find another job and can't afford to lose this one. What can I do?  Harassment against a whistleblower is illegal. Any employer should think twice before allowing harassment, as the law not only protects an employee's rights, but also entitles the whistleblower to certain monetary damages for harm done. The law states that this shall include "reinstatement with the same seniority status... two times the amount of back pay, interest on any back pay, and compensation for any special damages."
     
  3. Who can file a qui tam lawsuit?  Anyone with knowledge of fraudulent use of government funds may file a qui tam suit. This would include employees or former employees of the defrauding company, competitors or subcontractors of the defrauding company, state and local governments, federal employees, public interest groups, or private citizens.
     
  4. Was the Federal False Claims Act just recently passed? It seems that I never heard of it until lately.  Actually, the Federal False Claims Act has been in effect since 1863. It was not until 1986, when the qui tam provisions were added that important protections and safeguards were enacted for whistleblowers. The qui tam provisions also made it easier for an individual to file suit under this act.
     
  5. How do I find experts to help me with my whistleblower case?  Your attorney can suggest a team of experts to help develop your case. It is important to choose a lawyer that is experienced in whistleblower law.
